Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of Why Islam Is True (“WIT”, the “Service”), an online learning and video-streaming platform operated by and powered by Basira Education(“Basira Education”, “we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

Eligibility & accounts

You must be at least 13 years old (or the age of majority or digital consent in your jurisdiction, or have your parent or guardian’s consent) to use the Service. You agree to provide accurate information, keep your password confidential, and you are responsible for all activity under your account. Accounts are personal to you and may not be shared, resold, or transferred.

Subscriptions, billing & refunds

Some content is free; some requires a paid subscription or purchase. Paid plans are billed through our payment provider (Stripe) and are purchased and managed through your WIT account. Subscriptions renew automatically until cancelled; you may cancel at any time and keep access until the end of the current billing period. Refunds, where offered, are described at the point of purchase and are otherwise granted at our discretion as required by applicable law. Applicable taxes may be added. Our mobile apps are provided for viewing content; subscriptions are purchased and managed through your account.

Licence to use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, and revocable licence to access and view the content for your own personal, non-commercial educational use. Offline downloads, where available in the mobile app, are for your personal use only and remain subject to these Terms.

Intellectual property

The Service and its content — including courses, videos, text, graphics, logos, and software — are owned by or licensed to Basira Education and are protected by intellectual-property laws. “Why Islam Is True”, “Basira Education”, and related marks are our trademarks. You may not copy, download (except through features we provide), redistribute, publicly perform, modify, or create derivative works from the content without our prior written permission.

Your content

The Service may let you create content such as notes, written submissions, questions, and forum posts. You retain ownership of your content. By posting it, you grant Basira Education a worldwide, royalty-free, non-exclusive licence to host, store, display, and use it to operate and improve the Service. You are responsible for your content and confirm you have the rights to share it. We may remove content that violates these Terms.

Acceptable use

You agree not to:

• use the Service unlawfully or for any unauthorised purpose;
• share, resell, or give others access to your account;
• circumvent, disable, or interfere with security or content-protection features, including downloading or scraping video streams;
• harass or abuse others, or post unlawful, hateful, or infringing content;
• upload malware or attempt to disrupt the Service;
• reverse-engineer, copy, or resell the Service; or
• use the Service to build a competing product.

Community & conduct

Community features (such as questions and forums) must be used respectfully. We may moderate, edit, or remove content and suspend accounts that violate these Terms or our community standards.

Third-party services

The Service relies on third parties (for example, payment processing, video hosting, app stores, and sign-in providers) and may link to third-party content. We are not responsible for third-party services or their terms.

Disclaimers

The Service and its educational content are provided “as is” and “as available”, without warranties of any kind, whether express or implied. Content is for general educational purposes and is not professional advice. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Limitation of liability

To the maximum extent permitted by law, Basira Education and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us for the Service in the 12 months before the claim.

Indemnification

You agree to indemnify and hold harmless Basira Education from any claims arising out of your use of the Service, your content, or your breach of these Terms.

Suspension & termination

We may suspend or terminate your access at any time if you breach these Terms or to protect the Service or other users. You may stop using the Service and delete your account at any time. Provisions that by their nature should survive termination will survive.

Governing law & disputes

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict-of-laws rules. You agree to the jurisdiction of the courts located in Ontario, Canada, except where local consumer-protection law gives you the right to bring proceedings in your own jurisdiction.

Changes to these Terms

We may update these Terms from time to time. We will post material changes here with a new “Last updated” date. Your continued use of the Service after a change means you accept the updated Terms.
